General terms and conditions for the purchase of tickets
The following general terms and conditions of business and payment apply to the purchase of tickets for exhibitions or events at Port des Lumières.
For better reading, we use the masculine form in the text of our communications. However, all genders are always meant.
1. Conclusion of contract / event dates in general
The contractual agreement for the purchase of tickets exists between Culturespaces Germany GmbH | Port des Lumières, Platz am 10.Längengrad 1, 20457 Hamburg, 040-238359772, ahoi@port-lumieres.com, registered in Commercial Register B of Dortmund Local Court under HRB34178, represented by the Managing Director, Foulques d'Aboville, VAT identification no.: DE35 539 8000, hereinafter referred to as “Port des Lumières”, and the customer. Tickets are only sold to final customers and authorized dealers. In the event of unauthorized resale to other customers in its own name and for its own account, Port des Lumières reserves the right to withdraw from the contract within 30 days of its conclusion.
The customer is a consumer insofar as the purpose of the ordered goods and services cannot be predominantly attributed to his commercial or independent professional activity. An entrepreneur, on the other hand, is any natural or legal person or partnership with legal capacity who, when concluding the contract, is acting in the exercise of their commercial or independent professional activity.
The customer can select a number of tickets in the categories offered for the exhibition from the “Port des Lumières” range and collect them in a so-called shopping cart using the “add to cart” button. By using the “order with obligation to pay” button, the customer submits a binding request to purchase the tickets in the shopping cart. Before submitting the order, the customer can change and view the data at any time. However, the application can only be submitted and transmitted if the customer has accepted these General Terms and Conditions by clicking on the button “I agree to the General Terms and Conditions and Terms of Payment” and has thereby included them in his application.
The customer can select a number of tickets in the categories offered for the exhibition from the “Port des Lumières” range and collect them in a so-called shopping cart using the “add to cart” button. By using the “order with obligation to pay” button, the customer submits a binding request to purchase the tickets in the shopping cart. Before submitting the order, the customer can change and view the data at any time. However, the application can only be submitted and transmitted if the customer has accepted these General Terms and Conditions by clicking on the button “I agree to the General Terms and Conditions and Terms of Payment” and has thereby included them in his application. The text of the contract is stored in compliance with data protection regulations.
The contract is concluded in German.
2. Payment
Payment is made online by credit card (Visa and Mastercard) or PayPal. Other cashless payment methods are accepted on site (Visa and Mastercard, GiroPay, ApplePay, GooglePay, PayPal).
Tickets and vouchers can be purchased on site during our regular opening hours. We would like to explicitly point out that all payment transactions are cashless and no cash can be accepted. We recommend booking in advance via the online ticket store, also to book a time slot directly and avoid unnecessary waiting times.
Payment for tickets is only possible in euros.
2.1 Payment process
The customer's bank account will be debited as soon as the transaction has been accepted by the online payment system.
2.2 Order confirmation
As soon as the transaction has been completed, the customer will receive an order confirmation by e-mail to the e-mail address provided when placing the order.
2.3 Secure online payments
All payments are processed directly via the secure servers of our partner Adyen. No customer bank details are transmitted or stored via our website.
The customer's bank details are encrypted using an SSL (Secure Socket Layer) procedure. Port des Lumières has no access to this information and does not store any of the customer's payment-related information on its servers.
3 Delivery
Tickets ordered online will be sent to the e-mail address provided by the customer.The ticket can be printed out or presented in digital form on the screen of a smartphone or tablet by the customer at the entrance.
Admission will only be granted for tickets with a complete barcode/QR code.
4. Groups
4.1 Definition
To use the group rate, a group must consist of at least 20 paying persons. The maximum number of participants is fifty (50) persons per group.
- Adult groups: This rate applies to all groups with persons who are 16 years old or older.
- School groups: This rate applies to all school groups (regardless of the age of the pupils) who visit Port des Lumières as part of their studies and can provide proof of school attendance.
4.2 Group bookings
Group bookings can only be made via the online booking process (with a minimum of twenty (20) people). School groups or groups of more than fifty (50) people can only book by e-mail via: gruppen@port-lumieres.com
4.3 Group access
On the day of the visit, the full group goes directly to the entrance.Individual admissions are not possible.
The tickets are only valid for the date and time booked and have a waiting period for admission of 30 minutes after the start of the booked time slot. After this time, the tickets may lose their validity.
A refund of the purchase price or an exchange of the tickets is not possible if the customer is at fault.
5. Tickets and discounts
5.1 Ticket
A visit to Port des Lumières is only possible on presentation of a valid ticket.The customer is obliged to present his ticket(s) to a Port des Lumières employee upon request.
If the Customer is not willing or able to comply with this request, access to Port des Lumières may be denied.
5.2 Resale
The resale of tickets is not permitted without the prior consent of Port des Lumières.
5.3 Loss
If the ticket is lost or stolen before the visit to Port des Lumières, the admission price will not be refunded.
5.4 Proof
For discounts, valid proof must be presented at the ticket office before the ticket is purchased (on site). In the case of online purchases, the valid proof must be presented at the entrance without being asked.
6. Revocation and cancellation
According to paragraph 312 g section 2 no. 9 of the German Civil Code (BGB), there is no right of revocation for contracts for the provision of services in connection with leisure activities if the contract provides for a specific date or period for the provision of services, even if they were booked by means of distance selling.
During the ticket ordering process, the customer will be informed in real time about the availability of the desired time slot. When purchasing vouchers for tickets, a time slot can be selected upon subsequent redemption.
The customer cannot revoke his declaration of intent in this case.
The statutory warranty for defects applies.
Purchased tickets cannot be canceled.
Reductions in the number of participants in a group (group tickets) may be made in individual cases upon prior request. Any adjustments to group bookings must be requested at least seven (7) days before the date of the visit by email to: gruppen@port-lumieres.com.
7. Validity
Tickets are only valid for the date and time booked and have a waiting period for admission of 30 minutes after the start of the booked time slot. After this time, the tickets may lose their validity.
During the ticket ordering process, the customer will be informed in real time about the availability of the desired time slot.When purchasing vouchers for tickets, a time slot can be selected upon subsequent redemption.
It is strictly forbidden to duplicate, copy or falsify a ticket in any way.
Anyone who illegally reproduces a ticket and/or uses a counterfeit ticket is liable to prosecution. Port des Lumières will refuse entry to the venue to anyone in possession of a ticket with an already scanned barcode.
8. Liability and reimbursement
Claims of the customer for damages are excluded. Excluded from this are claims for damages by the customer arising from injury to life, limb or health or from the breach of essential contractual obligations (cardinal obligations) as well as liability for other damages based on an intentional or grossly negligent breach of duty by Port des Lumières, its legal representatives or vicarious agents. Essential contractual obligations are those whose fulfillment is necessary to achieve the objective of the contract.
In the event of a violation of essential contractual obligations, Port des Lumières shall only be liable for the foreseeable damage typical of the contract if this was caused by simple negligence, unless the Customer's claims for damages are based on injury to life, limb or health.
The above restrictions shall also apply in favor of the legal representatives and vicarious agents of Port des Lumières if claims are asserted directly against them
Individual rooms or individual sections of Port des Lumières may be temporarily closed for structural or organizational reasons. In this case, the customer will be offered an equivalent alternative or the price of the product will be refunded.
In such cases, there is no further right to compensation.
The Port des Lumières accepts no liability for any cancellation of an event due to force majeure or other circumstances that cannot be attributed to the Port des Lumières.
If a visitor is excluded due to a violation of the terms of use, they are not entitled to a refund of the price of the product in question (admission or event ticket).
9. Final terms
Contracts between the Port des Lumières and customers shall be governed by the law of the Federal Republic of Germany to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The statutory provisions restricting the choice of law and the applicability of mandatory provisions, in particular of the country in which the customer as a consumer has his habitual residence, shall remain unaffected.
If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and Port des Lumières shall be Hamburg.
The contract shall remain binding in its remaining parts even if individual points are legally invalid. The ineffective points shall be replaced by the statutory provisions, if any. However, if this would constitute an unreasonable hardship for one of the contracting parties, the contract as a whole shall become invalid.
Port des Lumières is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
